I am in the process of setting up a tailoring made-to-measure suit business - I have a name for my business which I wish to protect - how do I go about doing this? What is the correct terminology and how much will it cost me?
If you create a limited company no other company can be registered with the same name. This does not prevent someone else using your name as a trading name. If their doing so could mislead the public, for example because they are in the same business as you, you can take injunction proceedings preventing them from doing so claiming that they are "passing off" by using your name. Such proceedings can also seek an account of the money they have earned and damages for the money you have lost.
